Surprise, surprise: Google has just emerged victorious in its legal battle against a $1.7 billion fine imposed by the European Union. The fine, originally levied in 2019, was related to alleged anti-competitive practices in Google’s AdSense business. However, the EU’s General Court has now annulled the penalty, awarding the search engine behemoth a massive win.
The case, which dates back to practices between 2006 and 2016, accused Google of abusing its market dominance to prevent websites from using advertising brokers other than its AdSense platform.
While the court largely agreed with the European Commission’s assessment of Google’s behavior, it found that the Commission failed to consider all relevant circumstances, particularly in demonstrating how Google’s actions may have stifled innovation, reinforced its dominant position, or harmed consumers.
Such is the complex nature of antitrust cases in the tech sector. Regulators have been having a hard time proving the long-term impacts of alleged anti-competitive practices, especially when it comes to major tech companies.
Google, as expected, welcomed the court’s decision. The company pointed out that the case involved a narrow subset of text-only search ads and that they had already made changes to their contracts in 2016, even before the Commission’s original ruling.
However, the plot thickens when we consider the broader context of EU vs. Big Tech legal battles. This ruling comes on the heels of two major victories for the EU against tech giants – one against Google in a separate case and another against Apple regarding tax deals with Ireland.
Meanwhile, in a separate but related development, chipmaker Qualcomm faced a less fortunate outcome. The same court largely upheld a €242 million fine against Qualcomm for predatory pricing of baseband chips, only slightly reducing it to €238.7 million.
